05/12/2004: On Morning Sedition this morning....
they're talking to Harvard law professor Alan "legend in his own mind" Dershowitz about the Abu Ghuraib prisoner abuse issue. Dershowitz raises an interesting point, namely, that the pictures of the systematic torture of Iraqis there is going to push the Supreme Court to issue a "correct" ruling in the Guantanamo detention cases. Basically, before the Abu Ghuraib photos, Dershowitz was leaning to the belief that the Court would accept the Bush bAdministration's argument that we can trust the military to police itself to prevent abuses of the extraordinary powers that the detention situation provided them. Now, says Dershowitz, the military has proved that it can't be trusted, and most likely this will push the swing votes on the court away from the bAdministration's position and in favor of some sort of judicial supervision.
